Hon. James "Jay" C. Francis IV (Ret.) joins JAMS after serving for 32 years as a United States magistrate judge in the Southern District of New York, including a two-year term as chief magistrate judge. During his tenure, Judge Francis was responsible for conducting pretrial proceedings and mediating settlements, and presiding over trial in thousands of cases. The matters he handled include financial markets claims, employment discrimination class actions, wage and hour collective actions, multidistrict product liability litigation, civil rights class actions, mass torts, securities class actions, admiralty cases, copyright and trademark claims, patent infringement cases and a wide array of complex commercial litigation. He successfully resolved claims brought by the Federal Housing Finance Agency against numerous banking institutions in the wake of the 2008 financial crisis, some of which settled for well more than $1 billion. He also settled securities and commodities fraud claims arising from the collapse of MF Global. In the civil rights arena, Judge Francis achieved settlement of a class action together with scores of individual claims brought against the City of New York in the wake of arrests made at the 2004 Republican National Convention. He also mediated the infamous case brought by Tom Brady and the NFL Players Association against the National Football League, commonly known as “Deflategate.”
Judge Francis is nationally recognized as an expert in electronic discovery. He has spoken on the topic at the judicial conferences of both the Third and Ninth Circuits, as well as at programs such as the Georgetown Law School Advanced eDiscovery Institute, annual meetings of the Sedona Conference and the ABA Cross-Border Institute. He is the author of numerous opinions concerning e-discovery, having addressed such issues as the obligation to preserve data, proportionality and cost-shifting.
Prior to his appointment as a magistrate judge, Judge Francis was an attorney with the impact litigation unit of the Legal Aid Society of New York. There, he litigated class actions and test cases in the areas of housing and education. He also established the Disability Rights Unit to provide legal services for persons with physical and mental disabilities.
After stepping down from the bench in 2017, Judge Francis served as distinguished lecturer at the CUNY School of Law, where he taught Civil Procedure, Evidence, Electronic Discovery, Constitutional Torts and Federal Courts.
Over his 32 years on the bench, Judge Francis tried complex cases, including mass tort, employment discrimination and breach of contract actions, and he issued opinions on dispositive motions in countless others. In hundreds of matters, he guided the parties to resolution without trial, and his ability to settle cases was recognized when he was asked to teach mediation skills to members of the Egyptian judiciary in Cairo under the auspices of the ABA Rule of Law Initiative. He also serves on the faculty in the Sedona Conference eDiscovery Negotiation Training program. Judge Francis has particular experience in the following areas:
